General Terms and Conditions Diving School
Master Diving Makadi (diving courses and diving packages)
1 Scope of application
1.1 The following General Terms and Conditions (GTC) apply to all bookings made by the customer with Master Diving, www.masterdivingcenter.com
1.2 The booking is carried out in accordance with the GTC valid at the time of booking. These are available in their current version on the website under the menu item "GTC".
2 Conclusion of the contract
2.1 Unless otherwise agreed, the contract between the diving school Master Diving and the customer is concluded via the website or e-mail contact.
2.2 The presentation of the services on the website does not constitute a legally binding offer from Master Diving to the customer. Only after entering the required data and clicking the "Book with obligation to pay" button in the final step of the booking process does the customer submit a legally binding offer to Master Diving in relation to the services selected by the customer.
2.3 The customer can correct all entries at any time using the usual keyboard and mouse functions before the binding conclusion of the booking.
2.4 All entries are displayed once again in a confirmation window before the binding conclusion of the booking and can also be corrected there by the customer using the usual keyboard and mouse functions.
2.5 The customer shall receive a non-binding confirmation of receipt of the booking by e-mail immediately after receipt of the booking.
3 Subject matter of the contract
3.1 The subject of the contracts concluded with Master Diving are the diving courses and diving packages offered by Master Diving. The exact content is determined by the respective published service description and the information on the website or by individual agreements with the customer.
3.2 Persons who have either reached the age of 18 at the time of booking or whose legal representatives have consented to the booking are eligible to book. By making a booking, the customer expressly confirms that these conditions are met.
3.3 Master Diving reserves the right to slightly adjust the course duration and content. A change of instructor does not entitle the customer to withdraw from the contract.
4 Utilization of third party services (PADI)
4.1 The diving courses offered by Master Diving include services provided by a third party. This is the Professional Association of Diving Instructors (PADI), which in particular provides course materials and issues diving certificates.
4.2 The use of PADI services is required in order to complete a diving course at Master Diving. Master Diving accepts the costs incurred for this from the customer and forwards them to PADI.
5 Obligations of the customer
5.1 The customer must follow the instructions of Master Diving in the course of the diving courses. Allergies, illnesses and health restrictions must be communicated before the start of the diving course.
5.2 Customers are responsible for their state of health and are aware that diving involves physical exertion. The physical activity of the customer is at their own responsibility and risk.
5.3 The customer or participant is obliged to cooperate. In particular, they must ensure that the required examinations are completed within the time specified by Master Diving and that diving course dates are adhered to.
6 Course fees
6.1 The course fees include the services of Master Diving (diving fees) and PADI (PADI fees, e-learning and e-card. Physical diving certificates must be ordered directly from PADI and cost extra).
6.2 The services of Master Diving are provided and invoiced in its own name.
7 Prices and terms of payment
7.1 The prices quoted on the day of booking are authoritative and include the applicable statutory VAT.
7.2 Unless otherwise agreed, all payments must be made in cash or by bank transfer immediately after conclusion of the contract.
8 Withdrawal and non-appearance
8.1 The customer can withdraw from the contract up to 7 days before the start of the diving course at the latest (the first day of the diving course is decisive in the case of several dates). In this case, Master Diving will charge half of the diving fee and the full PADI fee.8.2 If a customer withdraws from the contract for health reasons and has already received the e-learning from PADI, this fee will not be refunded.8.3 If the withdrawal is not made within the period mentioned under 8.1 or if the customer does not show up for the booked diving course, Master Diving will charge the full course fee (diving fee and PADI fee).8.4 In the event of cancellation, the respective transaction fees will be charged to the customer.8.5 Cancellation must be declared in writing.
